In order to address your needs and provide you with better service, PATRONATO PRO NIÑOS DE SAN MIGUEL DE ALLENDE, ASOCIACIÓN CIVIL, hereinafter PRO NIÑOS DE SAN MIGUEL, must collect certain personal information and will be responsible for collecting your personal data, for the use made of such data, and for its protection.
PRO NIÑOS DE SAN MIGUEL is domiciled at Avenida Reforma No. 75-C, Colonia Ignacio Ramírez, in the city of San Miguel de Allende, State of Guanajuato, Postal Code 37700.
Your personal information will be used to provide the services you have requested by participating in our medical, dental, and/or psychological care and consultation programs for children and adolescents of limited financial means; to conduct socioeconomic studies concerning you and your family environment in order to verify that the minors are eligible to receive our services; to include them in our beneficiary registry; to prepare and submit our informational, regulatory, results, impact, and other reports, both internally and as required by the various government bodies and institutions authorized by law to supervise and endorse our work, as well as by our various donors, whether individuals, legal entities, or government entities, that request them; to inform you of changes or new services; to comply with obligations undertaken with our beneficiaries and with the competent authorities under applicable law; to provide you with advice and guidance in obtaining services; to evaluate the quality of the service we provide; for statistical and research purposes; and to maintain a history of services, among other purposes. All of these purposes are necessary for the legal relationship that you will maintain with PRO NIÑOS DE SAN MIGUEL. In addition, we may request your express authorization to use your image together with images of other persons in order to promote the services we provide.
PRO NIÑOS DE SAN MIGUEL will not share your information with third parties for commercial or other purposes except as specified in the preceding paragraph, nor will it request information for purposes that are unnecessary to the legal relationship you will maintain with it. Accordingly, our enrollment in the Public Registry to Avoid Advertising (REPEP), administered by the Federal Consumer Protection Agency (PROFECO), is not applicable.
For the aforementioned purposes, and subject to applicable legal provisions, we may require and obtain, among other things, the following personal data from you as the father, mother, guardian, or female guardian of the minor or minors, as well as from the minors themselves with respect to their health status for the care that may be provided to them: name; nationality; place and date of birth; gender; marital status; occupation; address; level of education; Federal Taxpayer Registry number (RFC); Unique Population Registry Code (CURP); a copy of your official identification; a copy of each minor's school identification card, if available; a copy of proof of address; home and mobile telephone numbers; email address; landline and mobile numbers of two family members for emergencies; and general information concerning the minors' health. Such health information must include their principal illnesses and surgeries throughout their lives, current illnesses, medications and treatments currently administered, general information regarding their physical, psychological, and nutritional condition, allergies, and other matters; the name, address, and telephone number of their treating physician; whether or not they are beneficiaries of any medical service, such as the Mexican Social Security Institute (IMSS) or the Institute for Social Security and Services for State Workers (ISSSTE), including proof that they are not affiliated with those institutions; approximate monthly income; and information relating to you and your family environment, such as the number of family members, the income and expenses of you and family members living with you, whether you receive a pension from IMSS or ISSSTE, whether you receive any type of family and/or government assistance, and other information customarily included in a socioeconomic study.
PRO NIÑOS DE SAN MIGUEL recognizes that the personal data of children and adolescents require an enhanced level of protection and will be processed only with the consent of their mother, father, or legal guardian and exclusively for the purposes described in this Notice.
All of these data are collected directly and personally when you provide them to us, after this Comprehensive Privacy Notice has been made available to you, through our social workers, physicians, psychologists, dentists, activity coordinators, and/or other administrative personnel of PRO NIÑOS DE SAN MIGUEL, as applicable. Your signature or fingerprint will be obtained to express your consent to the use and processing of your personal data and those of the minors. No other data considered sensitive or financial under the Federal Law on Protection of Personal Data Held by Private Parties will be requested. The only data considered sensitive under that law that will be requested are those relating to your financial circumstances, including your income, social security, and economic-family environment, through the corresponding socioeconomic study conducted by our personnel, as well as information concerning the minors' health and/or psychological condition, so that this information may be considered in the services to be provided.
By providing those data and signing or placing your fingerprint in the space relating to the Short-Form Privacy Notice contained in the “Service Application” that will be provided by our personnel for these purposes, you expressly accept the terms and conditions contained in this COMPREHENSIVE PRIVACY NOTICE and expressly consent to the use of those data under the terms specified herein, unless you limit such use on the same form when completing it or subsequently through the exercise of your ARCO Rights.
By way of illustration and without limitation, PRO NIÑOS DE SAN MIGUEL will process personal data for the following purposes:
Such information will be treated as strictly confidential and will be properly stored and subsequently deleted once our legal relationship has ended and the information-retention periods imposed upon us by various legal provisions have elapsed. PRO NIÑOS DE SAN MIGUEL undertakes to use its best efforts to protect the security of the personal data provided by THE DATA SUBJECT, through the execution of the necessary legal instruments and the use of technologies that control unauthorized access to, use of, or disclosure of personal information. For this purpose, the information will be stored in restricted-access databases located in controlled facilities equipped with security mechanisms. PRO NIÑOS DE SAN MIGUEL further undertakes to ensure that information provided by THE DATA SUBJECT is treated as confidential by its personnel and used with full respect for privacy.
Your personal data will be processed in accordance with the principles of legality, quality, consent, information, purpose, loyalty, proportionality, and accountability described in the Federal Law on Protection of Personal Data Held by Private Parties.
You have the right to access the personal data in our possession and the details of its processing, in printed or electronic form, according to the manner in which you request it; to rectify such data if it is inaccurate or incomplete; to cancel it in cases where cancellation is legally available, when you consider that it is not required for any of the purposes stated in this Privacy Notice or is being used for purposes to which you did not consent; to object to its processing for specific purposes; and to revoke any consent you have granted for such purpose, where legally permitted.
The mechanisms implemented for the exercise of these rights consist of submitting the corresponding request, which will be emailed to you upon request or delivered directly at the offices of PRO NIÑOS DE SAN MIGUEL. The completed request must contain the following information:
Your name and address for receiving notices; identification, or a notarized power of attorney if the request is made by an attorney-in-fact or legal representative; a clear and precise description of the personal data with respect to which you seek to exercise any right of access, rectification, cancellation, objection, or revocation (ARCO Rights); and any other item or document that facilitates locating the personal data. If the information is to be modified, you must state the reason for the modification and attach supporting documents. Your request will be decided within a maximum of twenty business days, counted from the day following receipt of your request, and the response regarding whether it is granted will be delivered to the address designated by you for that purpose, via the Internet, or directly at the offices of PRO NIÑOS DE SAN MIGUEL. If your request is granted, it will be implemented within fifteen business days following the date the response is issued. The procedure is free of charge, except for photocopying and shipping expenses, where applicable.
If the request submitted by THE DATA SUBJECT contains any inconsistency or lacks any data or information, within the aforementioned period PRO NIÑOS DE SAN MIGUEL will notify you of the omission and request the missing information or clarification. In that case, the response period will begin when the deficiency has been corrected.

PRO NIÑOS DE SAN MIGUEL undertakes not to transfer your personal information to third parties for purposes other than those stated in this Privacy Notice.

PRO NIÑOS DE SAN MIGUEL may also transfer your personal information in the exceptional cases provided in Article 37 of the Federal Law on Protection of Personal Data Held by Private Parties. In all such cases, PRO NIÑOS DE SAN MIGUEL is obligated to carry out the transfer under the terms established by that law, because in providing our services it is necessary to transfer your personal information to our affiliated and service companies and, where applicable, to our suppliers and partners; to service providers in the fields of health, dentistry, psychology, nutrition, and other similar fields or fields appropriate to addressing the needs of minors; to providers of external-audit, computer-systems, and consulting services that are necessary and/or appropriate for compliance with administrative, tax, and legal obligations and for the development of the activities carried out by PRO NIÑOS DE SAN MIGUEL, and who, by the nature of their work, may have access to the personal information of our beneficiaries; to the authorities that supervise our activities; to the Tax Administration Service, which also supervises our activities because we are an authorized donee; to federal and state institutions and agencies to which, under applicable law, we are required to submit reports concerning our beneficiaries; to the provider that supervises and maintains our systems and databases; and to accountants and attorneys, all by reason of the nature of their activities. It may also be transferred to the administrative personnel and suppliers of PRO NIÑOS DE SAN MIGUEL in order to carry out the indicated procedures and services. Likewise, your personal data may be transferred to third parties solely and exclusively for the provision of services rendered to you and for the other rights and obligations arising from those services, and to physicians and hospitals or health centers in the event of a medical emergency. In all such cases, the transfer of your data is necessary without your express consent. In such cases, we undertake to ensure compliance with all legal provisions governing the protection of personal-data transfers and that this Privacy Notice is respected at all times by us and our partners. Nevertheless, if an information leak occurs at any stage of data processing and significantly affects the rights of THE DATA SUBJECT, PRO NIÑOS DE SAN MIGUEL will notify THE DATA SUBJECT immediately upon learning of it so that the latter may take appropriate measures to defend their interests or rights. PRO NIÑOS DE SAN MIGUEL will bear no responsibility if the information leak is not attributable to it. The aforementioned notice will be given by email or telephone.
We reserve the right to modify or update this Privacy Notice at any time in response to legislative developments, internal policies, or new requirements for providing or offering our services. These modifications will be made available to the public through any of the following means: (i) notices displayed visibly in our offices; (ii) our website, www.patronatoproninos.org, in the Privacy Notice section; or (iii) delivery to the most recent email address you have provided to us.
THE DATA SUBJECT is responsible for reviewing this Privacy Notice for any update or modification that may affect their interests. PRO NIÑOS DE SAN MIGUEL will not be responsible if THE DATA SUBJECT is unaware of modifications to this Privacy Notice; its responsibility is limited to that stated in the preceding paragraph.
Failure by THE DATA SUBJECT to express disagreement with the terms and conditions set forth in this Privacy Notice constitutes adherence to, consent to, and authorization of all of its terms.
If you believe that your right to personal-data protection has been infringed by any conduct of our employees or by our actions or responses, or if you believe that the processing of your personal data violates any provision of the Federal Law on Protection of Personal Data Held by Private Parties, you may file the corresponding complaint or report with the Directorate of Transparency for the People of the Ministry of Anticorruption and Good Government.
